This Agreement is legally binding between you (“User”, “you” or “your”) and Simply Earth Boutique (“Simply Earth Boutique”, “we”, “us” or “our”). Accounts and membership

By using the Website and Services and by agreeing to this Agreement you warrant and represent that you are at least 13 years of age. If you create an account on the Website, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it. If we delete your account for the foregoing reasons, you may not re-register for our Services. We may block your email address and Internet protocol address to prevent further registration.

User content

We do not own any data, information or material (collectively, “Content”) that you submit on the Website in the course of using the Service. You shall have sole responsibility for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use of all submitted Content. We may monitor and review the Content on the Website submitted or created using our Services by you. You grant us permission to access, copy, distribute, store, transmit, reformat, display and perform the Content of your user account solely as required for the purpose of providing the Services to you. Billing and payments

You shall pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. Sensitive and private data exchange happens over a SSL secured communication channel and is encrypted and protected with digital signatures, and the Website and Services are also in compliance with PCI vulnerability standards in order to create as secure of an environment as possible for Users. Scans for malware are performed on a regular basis for additional security and protection. If, in our judgment, your purchase constitutes a high-risk transaction, we will require you to provide us with a copy of your valid government-issued photo identification, and possibly a copy of a recent bank statement for the credit or debit card used for the purchase. We reserve the right to change products and product pricing at any time. We also reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

Accuracy of information

Occasionally there may be information on the Website that contains typographical errors, inaccuracies or omissions that may relate to availability, promotions and offers. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on the Website or Services is inaccurate at any time without prior notice (including after you have submitted your order). We are not responsible for the Content residing on the Website. In no event shall we be held liable for any loss of any Content. It is your sole responsibility to maintain appropriate backup of your Content. Notwithstanding the foregoing, on some occasions and in certain circumstances, with absolutely no obligation, we may be able to restore some or all of your data that has been deleted as of a certain date and time when we may have backed up data for our own purposes. We make no guarantee that the data you need will be available.

Notice of Allergens

General Information

Your safety is important to us. We list the ingredients we use in our Signature Collection soaps directly on the relevant product page. For a list of the ingredients used in our themed soaps, visit our FAQ page. Please check the ingredients list for the products you plan to purchase before ordering.
If you request that your themed soaps or other topical products arrive unscented, no essential oils or fragrance oils will be added. If there is any scent at all to the finished product, it comes from the natural properties of the raw materials (ex. Cocoa Butter products may have a slight, natural scent of chocolate, etc.)

Some of our products may be made with a natural additive. If you request that your products arrive unscented and they include a natural additive, that may change the scent of the final product (ex. unscented soap with natural ground coffee added for exfoliation may smell like coffee, etc.)
Some natural additives can and will change color over time. They may also change the color of the finished products, either immediately after being added or over time.

We choose our ingredients very carefully. While allergic reactions are not expected to occur as a result of using our products, some people may be sensitive to certain ingredients. We list the ingredients for our products on our website. It is your responsibility to read the list before placing your order.
Our products also include a list of ingredients on the label or on a separate insert inside the shipping box if the product is too small for conventional labeling. Ingredient lists are updated and revised when our new products are released, at our discretion, and/or as needed based on the current availability of raw materials at the time.

Sensitivity and/or Allergies

If you do not know if you have a sensitivity or allergy to any of the listed ingredients, we advise doing a 24 hour patch test on a small area of your arm or leg (the wrist, the inside of your elbow, or behind your knee work well) before using the products on other areas of the body.
If you are buying our products as gifts, it is your responsibility to make sure the intended recipient(s) do not have sensitivities to and/or are not allergic to the any of the listed ingredients in the products you choose to purchase, and to furnish them with a complete ingredients list upon request.
Symptoms of sensitivity and/or an allergic reaction can include (but are not limited to) rashes, hives, itching, swelling, peeling, redness, pain, or burning. In some cases, reactions may be more severe. If you experience any of these symptoms, discontinue use and contact your doctor or a qualified healthcare provider.

Our products are intended for topical use only (on/for the skin) and should not be swallowed or ingested. Keep out of eyes. If this occurs, flush with plenty of clean water and contact your doctor, a qualified healthcare provider, or eye professional if needed.
If you have a known sensitivity or allergy to any of the ingredients in a product, please choose a different product without those ingredients. If we don't offer a product that fits that description, you may contact us to see if we may be able to offer another choice that is better suited to your needs.
We will do our best to try to accommodate your request and work with you to come up with a product that you'll love and be able to use. However, due to circumstances beyond our control, such as unavailability of raw materials (due to any number of reasons) we cannot guarantee that a suitable replacement will be available.

By placing your order, you are confirming that you have read and agree with this Notice of Allergens, and that you have read and acknowledge the complete ingredient lists for the products you plan to purchase and/or that are currently in your shopping cart.

Simply Earth Boutique accepts no liability or responsibility, financially or otherwise, due to improper use of our products; or if sensitivity issues or an allergic reaction occurs.

Wax Melts

Burn at Your Own Risk

We offer a variety of wax melts in different shapes, colors, and scents. Some may look like small toys; or smell and/or look like edible candies. Because of that they may appeal to young children. While the waxes we use are natural, the colorants and fragrances could cause health issues if they get into eyes or are ingested. To avoid possible injury, keep all wax tarts/melts away from children.

Electric wax warmers and tealight candle warmers can pose a serious fire risk and precautions should always be taken before, during, and after burning. Failure to follow proper safety precautions can result in extensive property damage, permanent injury, or death.

It is recommended that an electric wax warmer and/or a lit tealight candle wax warmer be placed on a heat resistant surface such as a candle plate or coaster to prevent possible heat damage to tables and other surfaces. Never burn near additional heat sources, any flammable objects such as curtains, clothes, cloth furniture, paper, etc., or where any drafts occur such as near air conditioner vents or open windows. Building and decorating materials such as wood, drywall, paint, etc. are extremely flammable. Never place a lit candle or electric wax warmer close to or up against a wall; make sure there is ample free space on all sides of the warmer at all times. Never leave a burning tealight candle unattended, especially around children and pets. It is best to place the warmer on a high surface where children and pets cannot reach it and do not have access to avoid accidents and spills.

Do not spray or store any flammable liquids around a lit candle or wax melts, including (but not limited to) cleaners, room fresheners, perfumes, colognes, etc. Glass and ceramic wax warmers can get hot after being on for a while. Always extinguish candle completely and allow it to cool before moving it to another location to avoid spilled wax and burns. Never attempt to extinguish tealight candles with water; it can make the flame grow larger and may make the glass container break or shatter.

We include instructions on how to properly use tealight candles and wax melts on our website. It is your responsibility to read and adhere to all safety precautions regarding these items.

Some people could have sensitivities and/or allergic reactions to certain fragrances; either before, during, or after use. If such sensitivity or allergic reaction occurs, discontinue use and seek medical attention if necessary.
Simply Earth Boutique accepts no liability or responsibility, financially or otherwise, due to or as a result of property damage, sensitivities or reactions, or any other bodily injuries sustained while using our wax melts or tealight candles. For injuries or damages relating to electric wax warmers, please contact the manufacturer.

Prohibited uses

In addition to other terms as set forth in the Agreement, you are prohibited from using the Website and Services or Content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Website and Services, third party products and services, or the Internet; (h) to spam, phish, pharm, pretext, spider, crawl, or scrape; (i) for any obscene or immoral purpose; or (j) to interfere with or circumvent the security features of the Website and Services, third party products and services, or the Internet. We reserve the right to terminate your use of the Website and Services for violating any of the prohibited uses.

Intellectual property rights

“Intellectual Property Rights” means all present and future rights conferred by statute, common law or equity in or in relation to any copyright and related rights, trademarks, designs, patents, inventions, goodwill and the right to sue for passing off, rights to inventions, rights to use, and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, rights to claim priority from, such rights and all similar or equivalent rights or forms of protection and any other results of intellectual activity which subsist or will subsist now or in the future in any part of the world. This Agreement does not transfer to you any intellectual property owned by Simply Earth Boutique or third parties, and all rights, titles, and interests in and to such property will remain (as between the parties) solely with Simply Earth Boutique. All trademarks, service marks, graphics and logos used in connection with the Website and Services, are trademarks or registered trademarks of Simply Earth Boutique or its licensors. Other trademarks, service marks, graphics and logos used in connection with the Website and Services may be the trademarks of other third parties. Your use of the Website and Services grants you no right or license to reproduce or otherwise use any of Simply Earth Boutique or third party trademarks.

Disclaimer of warranty

You agree that such Service is provided on an “as is” and “as available” basis and that your use of the Website and Services is solely at your own risk. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We make no warranty that the Services will meet your requirements, or that the Service will be uninterrupted, timely, secure, or error-free; nor do we make any warranty as to the results that may be obtained from the use of the Service or as to the accuracy or reliability of any information obtained through the Service or that defects in the Service will be corrected. Limitation of liability

To the fullest extent permitted by applicable law, in no event will Simply Earth Boutique, its affiliates, directors, officers, employees, agents, suppliers or licensors be liable to any person for any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if the liable party has been advised as to the possibility of such damages or could have foreseen such damages. To the maximum extent permitted by applicable law, the aggregate liability of Simply Earth Boutique and its affiliates, officers, employees, agents, suppliers and licensors relating to the services will be limited to an amount no greater than one dollar or any amounts actually paid in cash by you to Simply Earth Boutique for the prior one month period prior to the first event or occurrence giving rise to such liability. The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails of its essential purpose.


You agree to indemnify and hold Simply Earth Boutique and its affiliates, directors, officers, employees, agents, suppliers and licensors harmless from and against any liabilities, losses, damages or costs, including reasonable attorneys’ fees, incurred in connection with or arising from any third party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Website and Services or any willful misconduct on your part.


All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid or unenforceable.
