If you create an account on the Services, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it. Providing false contact information of any kind may result in the termination of your account. You must immediately notify us of any unauthorized uses of your account or any other breaches of security. We do not own any data, information or material (collectively, “Content”) that you submit on the Services in the course of using the Service. This Agreement does not transfer to you any intellectual property owned by Dubesoft ZakaApp or third parties, and all rights, titles, and interests in and to such property will remain (as between the parties) solely with Dubesoft ZakaApp. All trademarks, service marks, graphics and logos used in connection with the Services, are trademarks or registered trademarks of Dubesoft ZakaApp or its licensors. Other trademarks, service marks, graphics and logos used in connection with the Services may be the trademarks of other third parties. Your use of the Services grants you no right or license to reproduce or otherwise use any of Dubesoft ZakaApp or third party trademarks.
To the fullest extent permitted by applicable law, in no event will Dubesoft ZakaApp, its affiliates, directors, officers, employees, agents, suppliers or licensors be liable to any person for any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if the liable party has been advised as to the possibility of such damages or could have foreseen such damages. To the maximum extent permitted by applicable law, the aggregate liability of Dubesoft ZakaApp and its affiliates, officers, employees, agents, suppliers and licensors relating to the services will be limited to an amount no greater than one dollar or any amounts actually paid in cash by you to Dubesoft ZakaApp for the prior one month period prior to the first event or occurrence giving rise to such liability. The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails of its essential purpose.
You agree to indemnify and hold Dubesoft ZakaApp and its affiliates, directors, officers, employees, agents, suppliers and licensors harmless from and against any liabilities, losses, damages or costs, including reasonable attorneys’ fees, incurred in connection with or arising from any third party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Services or any willful misconduct on your part.
All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid or unenforceable. If any provision or portion of any provision of this Agreement shall be held to be illegal, invalid or unenforceable by a court of competent jurisdiction, it is the intention of the parties that the remaining provisions or portions thereof shall constitute their agreement with respect to the subject matter hereof, and all such remaining provisions or portions thereof shall remain in full force and effect.
The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of South Africa without regard to its rules on conflicts or choice of law and, to the extent applicable, the laws of South Africa. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in South Africa, and you hereby submit to the personal jurisdiction of such courts. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.

DUBESOFT (PTY) LTD is a business in the fintech industry that provides a wallet app similar to Momo from MTN and CashApp, facilitating peer-to-peer money transfers and other financial transactions.
2. Delivery policy
Subject to availability and receipt of payment, requests will be processed within 7 days and delivery confirmed by way of booking number/voucher. The use of courier and/or postal services will be utilized as needed, with associated costs applicable.
3. Export restriction
The offering on this website is available to South African clients only.
4. Return and Refunds policy
The provision of goods and services by DUBESOFT (PTY) LTD is subject to availability. In cases of unavailability, DUBESOFT (PTY) LTD will refund the client in full within 30 days. Payment may be made via Visa, MasterCard, Diners, or American Express Cards or by bank transfer into the DUBESOFT (PTY) LTD bank account, the details of which will be provided on request.
7. Card acquiring and security
Card transactions will be acquired for DUBESOFT (PTY) LTD via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
8. Customer details separate from card details
Customer details will be stored by DUBESOFT (PTY) LTD separately from card details which are entered by the client on DPO PayGate’s secure site. For more detail on DPO PayGate refer to www.paygate.co.za.
9. Merchant Outlet country and transaction currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).
10. Responsibility
DUBESOFT (PTY) LTD takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution, and delivery of goods.
11. Country of domicile
This website is governed by the laws of South Africa and DUBESOFT (PTY) LTD chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature 5 13TH AVENUE, FAIRLAND, RANDBURG 2170, Gauteng, South Africa.
